KeepCup is taking Gloria Jean's to court

The nation’s largest coffee chain is in hot water.

Australia’s leading coffee chain is in trouble. Gloria Jean’s is currently in the midst of being sued by coffee cup company KeepCup for allegedly copying a design.

KeepCup claim that Gloria Jean’s is selling a reusable glass cup with a band of cork around its centre that is “identical to, or substantially similar in overall impression” to the KeepCup design. The only difference between the two cups is the addition of the Gloria Jean’s logo. While KeepCup introduced its product in 2014, selling for $30, Gloria Jean’s version was welcomed to market only last year, at $22.

By taking the chain to court, KeepCup hopes to see Gloria Jean’s destroy all of its existing cork coffee cups, as well as pay damages for profits already made. As KeepCup is a small business taking on a major chain, the fight is going to be a tough one. It is believed that KeepCup’s claims will be hard to prove, but in a small victory for the Melbourne-based start-up, Gloria Jean’s has already pulled the product from shelves.

Perhaps what Gloria Jean’s should have done is follow in the footsteps of fellow foodie heavyweights McCafe and Toby’s Estate. Both have collaborated with KeepCup in the past on reusable products, but branded with both company’s logos.
